Radke was formally sentenced to 48 months of imprisonment in the High Desert State Prison in Nevada in 2008 following his role in a violent 2006 altercation that left 18-year-old Michael Cook dead. Radke failed to check in with his probation officer for two months that year, and was therefore taken into custody by U.S. Marshals in June 2008.


Since his time in prison he was replaced in Escape The Fate by former Blessthefall front man Craig Mabbitt. Radke's current band Falling In Reverse will now being work for their debut album.
